MAKLUMBALAS FAKULTI UNDANG-UNDANG UNISZA
Saya merujuk kepada surat yang telah diterbitkan dalam Akhbar Berita Harian bertarikh 23hb Mei 2013. Izinkan saya membuat maklumbalas bagi pihak Fakulti Undang-Undang dan Hubungan Antarabangsa, UniSZA.
Program Ijazah Sarjana Muda Undang-Undang UniSZA mula ditawarkan pada Sesi Akademik 2006/2007.Ia adalah program akademik 4 tahun dan kohot pertama program tersebut telah tamat pengajian pada Sesi Akademik 2009/2010. Program tersebut harus melalui proses akreditasi Agensi Kelayakan Malaysia dan proses pengiktirafan badan professional dari Lembaga Kelayakan Profesyen Undang-Undang. Mengikut prosedur sedia ada, akreditasi dan pengiktirafan ini tidak diperolehi secara automatik pada tarikh penawaran tetapi pihak fakulti perlu memohon daripada badan-badan berkenaan setelah program tersebut menghasilkan graduan bagi tujuan penilaian oleh badan-badan berkenaan.Rasionalnya adalah supaya badan-badan ini dapat menilai dan menaksir bukan sahaja program dan tenaga pengajar bagi program tersebut tetapi juga hasil daripada program tersebut, iaitu pelajar dan graduannya.
Pihak fakulti juga perlu mendapatkan akreditasi program daripada Agensi Kelayakan Malaysia sebelum boleh mendapatkan pengiktirafan dari pihak badan professional.Pengiktirafan adalah daripada pihak Lembaga Kelayakan Profesyen Undang-Undang dan bukannya dari pihak Badan Peguam Malaysia, walaupun Presiden Badan Peguam merupakan salah seorang daripada ahli Lembaga Kelayakan Profesyen Undang-Undang.
Usaha dalam menyediakan dokumen dan mengumpulkan data bagi tujuan permohonan untuk mendapatkan akreditasi dan pengiktirafan badan-badan tersebut telah bermula semenjak 2006 apabila program tersebut mula ditawarkan.Setelah program tersebut menghasilkan kohot pertama graduannya pada bulan Julai 2010, pihak fakulti telah memohon untuk mendapatkan akreditasi dari pihak Agensi Kelayakan Malaysia.
Selanjutnya, badan tersebut telah membuat lawatan penilaiannya pada bulan April 2011 dan telah mengeluarkan Sijil Akreditasi kepada pihak fakulti pada bulan Februari 2012.Dengan Sijil Akreditasi tersebut, pihak fakulti seterusnya memohon untuk mendapatkan pengiktirafan dari Lembaga Kelayakan Profesyen Undang-Undang dan badan tersebut telah membuat lawatan penilaiannya pada bulan November 2012. Seramai 4 orang Jawatankuasa Penilai dan 20 orang penilai-penilai kursus yang terdiri daripada ahli badan Peguam, Badan Kehakiman, Jabatan Peguam Negara dan seorang daripada Akademia telah membuat penilaian terhadap program tersebut, tenaga pengajar dan pelajar serta graduannya. Sehingga sekarang, pihak fakulti masih menunggu keputusan rasmi daripada pihak Lembaga Kelayakan Profesyen Undang-Undang terhadap permohonan UniSZA untuk mendapatkan pengiktirafan daripada badan tersebut.Dalam tempoh tersebut, 3 kohot pelajar program tersebut telahpun bergraduat daripada UniSZA.
Proses yang ketat untuk mendapatkan akreditasi daripada Agensi Kelayakan Malaysia dan pengiktirafan daripada Lembaga Kelayakan Profesyen Undang-Undang menjamin program Ijazah Sarjana Muda Undang-Undang yang ditawarkan adalah menepati piawaian. Dari segi prospek kerjaya, walaupun graduan Ijazah Sarjana Muda Undang-Undang UniSZA belum boleh beramal sebagai seorang peguambela dan peguamcara sehingga program tersebut diiktiraf oleh Lembaga Kelayakan Profesyen Undang-Undang, akan tetapi Ijazah Sarjana Muda Undang-Undang UniSZA adalah diiktiraf oleh Jabatan Perkhidmatan Awam sebagai setaraf dengan ijazah-ijazah lain.
Oleh itu, graduan Ijazah Sarjana Muda Undang-Undang UniSZA boleh mendapatkan pekerjaan yang setanding dengan ijazah lain. Mengikut statistik yang diperolehi juga, 80% graduan Ijazah Sarjana Muda Undang-Undang UniSZA memperolehi pekerjaan dalam tempoh 6 bulan selepas tamat pengajian, walaupun bukan sebagai seorang peguambela dan peguamcara. Pekerjaan-pekerjaan yang diceburi antara lainnya adalah dalam sektor perbankan, insurans, badan korporat, institusi pengajian tinggi, badan kerajaan, swasta dan lain-lain.
Pihak fakulti juga sentiasa mengadakan program-program untuk meningkatkan mutu program, tenaga pengajar dan pelajar-pelajar, disamping melantik pakar-pakar dalam bidang undang-undang untuk terus membantu meningkatkan kualiti program akademiknya. Sebagai contohnya, pihak fakulti telah melantik bekas Ketua Hakim Negara, Yang Amat Bahagia Tun Zaki bin Tun Azmi, sebagai Professor Adjung fakulti, di samping pakar-pakar lain dalam bidang undang-undang. Yang Amat Bahagia Tun Zaki dan pihak pengurusan tertinggi UniSZA, serta pihak Kementerian amat prihatin terhadap kualiti program akademik fakulti dan sentiasa memberi sokongan untuk fakulti terus maju dan berdaya saing.
Fakulti juga mempunyai Klinik Guaman yang dikhaskan untuk pelajar Tahun Professional (Tahun Akhir) bagi menjalani latihan praktikal kepeguaman pada tahun akhir pengajian mereka.Klinik Guaman ini mempunyai pejabat-pejabat berasaskan simulasi firma-firma guaman lengkap dengan komputer-komputer peribadi dan bilik-bilik mesyuarat.Saya difahamkan bahawa fasiliti sebegini hanya terdapat di UniSZA. Pelajar-pelajar program ini juga pernah memenangi “Harun M Hashim National Client Consultation Competition” pada tahun 2012 dan telah mewakili Malaysia di peringkat antarabangsa yang telah diadakan di Dublin, Ireland. Fakulti juga mempunyai hubungan baik dengan pihak industri seperti Jawatankuasa Peguam Negeri Terengganu dan pihak Mahkamah Kuala Terengganu bagi membantu fakulti terus meningkatkan mutu program akademiknya.

FACULTY FEEDBACK
I refer to the letter that was published in The Star newspaper dated 23th May 2013 . Allow me to respond on behalf of the Faculty of Law and International Relations , UniSZA .
Bachelor of Laws UniSZA was first offered in the Academic Session 2006/2007. It is a 4 year academic program and the program's first cohort graduated in the academic session 2009/2010 . The program had to go through the accreditation process by the Malaysian Qualifications Agency and the professional body recognition from the Qualifying Board Legal Profession . Under existing procedures , accreditation and recognition were acquired automatically on the date of the offering , but the faculty should only do so after the program has produced graduates for assessment by the relevant bodies. The rational for this, is that these bodies can assess and assess not only the program and instructors for the program but also as a result of the program, the students and graduates.
The faculty also need to get accreditation from the Malaysian Qualifications Agency (MQA) before they can get recognition from the professional body. The recognition is from the Legal Profession Qualifying Board instead of the Malaysian Bar, even the President of the Bar is a member of the Profession Qualifying Board itself .
Efforts in providing document and collecting data for the purpose of application for accreditation and recognition bodies have been started since 2006 when the program began offering. The program resulted in the first cohort graduates in July 2010, the faculty has already applied for accreditation from the Malaysian Qualifications Agency.
Further, the agency has made assessment visits in April 2011 and has issued a Certificate of Accreditation to the faculty in February 2012. With this Accreditation Certificate, the next action to be taken by the faculty is to apply for recognition from the Legal Profession Qualifying Board and the agency has made a trip evaluation in November 2012. A total of 4 Evaluation Committee and 20 course assessors consisting of members of the Bar , the Judiciary, the Attorney General and one of the Academia has made an assessment of the program, instructors , students and graduates. Until now , the faculty is still waiting for the official results of the Legal Profession Qualifying Board. During this period, the third cohort of students have already graduated from the program .
Rigorous process to earn accreditation from the Malaysian Qualifications Agency and the recognition of the Legal Profession Qualifying Board guarantee Bachelor of Laws offered is not sub-standard . In terms of career prospects , although graduates of Bachelor of Laws UniSZA cannot practice as an advocate and solicitor until the program is recognized by the Legal Profession Qualifying Board , but the degree of Bachelor of Laws UniSZA is recognized by the Department of Public Service as on a par with any other degree .
Thus, graduates of Bachelor of Laws UniSZA can get a comparable job with another degree . According to statistics obtained also , 80 % graduated with a Bachelor of Laws UniSZA were employed within 6 months after graduation, although not as an advocate and solicitor . The jobs they undertake , among others, are in the banking, insurance , corporate bodies , educational institutions , government bodies , private sector and others.
The faculty also conducts regular programs to improve the program , instructors and students , as well as to appoint experts in the field of law to continue to help improve the quality of its academic programs . For example , the faculty has appointed former Chief Justice Tun Zaki bin Tun Azmi as Professor Adjunct faculty, as well as other experts in the field of law . Tun Zaki and UniSZA top management , as well as the Ministry is concerned about the quality of academic programs and for faculty continues to grow and remain competitive .
Faculty also have the legal clinic dedicated to the students in Professional Year (Final Year) for practical training in advocacy. Legal Clinic is a simulation-based law firms offices, complete with personal computers and meeting rooms. Faculty also have good relationships with the industry such as the State Bar Committee and the Court of Kuala Terengganu to help faculty continue to improve the quality of its academic programs .
